EvLogica: means the company EvLogica Srls a single member with registered office in Via Marittina, 196 - 03100 Frosinone (FR), IT - P.IVA IT02969960604
Consumer: shall mean any natural person acting for purposes that are outside the scope of his/her commercial, industrial, handicraft or professional activity;
Purchaser: shall mean the user, consumer or not, who has sent an order electronically to EvLogica and/or has entered into a sales contract with the latter, having as object the purchase of the Product;
Product: shall mean the product on sale on the website popolone.it;
These general conditions of sale govern all purchases made on the website popolone.it, in accordance with the provisions of Part III, Title III, Chapter I, of the Consumer Code, Legislative Decree no. 206/2005, as amended by Legislative Decree no. 21/2014 and Legislative Decree no. 70/2003 on electronic commerce. These conditions may be subject to change and the date of publication of these conditions on the website popolone.it is equivalent to the date of entry into force2. Acceptance of the general conditions of sale
2.1 The Buyer, by sending the order electronically confirms that he has read understood and accepts these general conditions of sale. In the order confirmation e-mail, the Buyer will also receive the link (link) to download and store a copy of these general conditions of sale, as provided for in Article 51 paragraph 1 of Legislative Decree 206/2005, as amended by Legislative Decree 21/2014.3 Registration procedures
3.1 When registering, the Buyer must provide the data essential to the conclusion of the purchase order.4 Product prices
4.1 All prices shown on the popolone.co.uk website are in Euros and include VAT.5 Payment methods
5.1 Purchase orders are considered confirmed subject to "successful payment."
5.2 The payment methods accepted by EvLogica on popolone.co.uk are as follows:
Credit card and PayPal Account (VISA, VISA Electron, American Express, MasterCard, Postepay circuits).
Scalapay: If you buy with Scalapay you receive your order immediately and pay in the number of installments you have chosen. You acknowledge that the installments will be assigned to Incremento SPV S.r.l., related parties and their assignees, and you authorize such assignment
Bank Transfer: the Buyer must provide, within 24 hours of receipt of the order confirmation email, to make the payment indicating in the reason for payment the Order Number that he will receive by email, and send a copy of the bank transfer to EvLogica, under penalty of cancellation of the order. Failure to receive evidence of payment within the next two business days will result in the order being cancelled.
5.3 Financial data are not shared with EvLogica being handled solely by PayPal. Under no circumstances can EvLogica be held liable for any illicit and fraudulent use made by third parties to the detriment of the Credit Card Cell Holder and/or PayPal Account, as EvLogica does not have any kind of access to such data.
5.4 Upon receipt of the order, EvLogica, pursuant to art. 13 of Legislative Decree 70/2003, sends a confirmation email in which will be indicated the Order Number , the products purchased with their prices and shipping costs as well as The data to make the payment (Bank Transfer).
For each purchase made on the website popolone.it, EvLogica will issue the relevant invoice only upon request of the Buyer, who will be required to indicate VAT and/or Tax Code, SDI Univocal Code or PEC box. No changes in the invoice/receipt will be possible after its issuance.6 Shipping methods
6.1 Deliveries of the Products are made to the destination address indicated by the Buyer and are intended to be curbside.
6.2 Transportation costs are the responsibility of the Buyer.
6.3 The Products shipped are inspected and delivered to the courier without defects. EvLogica will not be responsible for damages and will not be able to undertake for their replacement or repair unless reported at the time of acceptance of the shipment by affixing the dispute on the courier's slip. Upon delivery to the Buyer is required to verify:
That the number of packages being delivered corresponds to what is indicated in the transport document anticipated by e-mail;
that the packaging is totally intact, undamaged or in any way altered. If this is the case, the Buyer MUST report any anomalies and affix the words "YOU ACCEPT WITH RESERVE" indicating the reason on the courier/electronic terminal bulletin.
6.4 The Buyer is required to check IMMEDIATELY the correct functionality and conformity of the Product: in case of detection of specific (APPARENT) DAMAGE, the Buyer is required to report it immediately to EvLogica within and not later than eight calendar days , or 2 months in case of Consumer from the date of delivery of the Product to the e-mail address email@example.com or through the Customer Service.
In case of product received damaged or non-compliant, it is MANDATORY to keep all parts constituting the ORIGINAL PACKAGING. In the absence of original packaging EvLogica will not be able to handle the return of the same and the dispute raised by the Buyer can not be accepted in any way.
6.5 The Buyer acknowledges that the pickup of the Product is its specific obligation under the purchase contract. In the event of non-delivery due to the absence of the recipient at the address specified in the order form, after two unsuccessful delivery attempts, the package will be placed "in storage."
In case of failure to collect the Product within 3 (three) working days from the first delivery attempt, the contract will be considered terminated and the purchase order consequently cancelled pursuant to art. 1456 c.c. Resolved the contract, EvLogica will proceed to refund the amount paid by the Buyer, after deducting the costs of unsuccessful shipping, the costs of return to EvLogica and any other expenses it may have incurred due to the non-delivery caused by the absence of the recipient.The termination of the contract and the amount of the refund will be communicated to the Buyer by e-mail.7 Right of withdrawal
7.1 In compliance with the provisions of D.LGS. N 206 of 06/09/2005 (Consumer Code) art. 47) the Consumer may freely and without any reason exercise the right of withdrawal, giving notice to EvLogica within thirty (30) working days from the day of receipt of the purchased Product by email to firstname.lastname@example.org.
7.2 EvLogica will proceed to refund the price of the Product subject to withdrawal once it has ascertained the integrity of the same and its normal state of preservation In this case, within thirty (30) working days of receipt of the goods in question and having verified the integrity of the Product, EvLogica will credit the Buyer with the amount corresponding to the value of the goods resulting from the invoice, excluding shipping costs incurred by EvLogica. The refund will be made by the same means of payment used by the Buyer to make the payment.
The right of withdrawal may be exercised only if the Product is perfectly INTEGRATED in every part (including the declaration of conformity (where applicable) and the corresponding serial number imprinted on hologram sticker and the original labels, catalogs, packaging and accessories received with the order) and in a normal state of preservation. The returned Product must not be deprived of its wrapping or parts thereof, nor bear any signs of tampering.
Should EvLogica receive the returned Product tampered with or damaged or misused, it will not refund the amount paid for the purchase of the same and the Product will be returned to the Buyer at the Buyer's care and expense.
7.3 The cost of returning the Product and any additional or incidental expenses related thereto shall be borne by the Consumer. The Purchaser shall ship the Product properly packaged in its original packaging complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc.).8 Product warranty
8.1 The warranty shall have the duration of:
two years from the date of invoice, and the complaint must be made within two months from the date of discovery of the defect (in the case of apparent defects, discovery coincides with delivery)
one year from delivery of the product to NON Consumer and the defect must be reported within eight days of discovery of the defect (in the case of apparent defects, discovery coincides with delivery)
8.2 The warranty shall be void in the event of:
Tampering with the Product by the Buyer or a third party
Incorrect or improper use or otherwise inconsistent with the enclosed documentation and instructions for use
Damage, accidents and breakdowns caused by transportation by means of the Buyer
8.3 Service Centers
In the event that a Manufacturer's Authorized Service Center exists for the Product, Buyer must bring or send the Product directly to the Authorized Service Center The CAT will make the necessary checks to ascertain whether or not the conformity defect complained of exists. In case the defect exists, if the Customer has chosen repair, the CAT will proceed with the repair. If, on the other hand, the Customer has chosen replacement, EvLogica will replace the Product.
If the CAT does not find the conformity defect, it will not be possible to apply the Legal Warranty and, therefore, the transport costs and any repair costs will be borne by the Buyer. EvLogica will inform the Buyer of the circumstance and the possible costs to be incurred for the repair, sending him the estimate issued by the CAT, so that the Buyer can decide whether or not to have the repair carried out at his own expense.9 Jurisdiction
